Video Upload, Copyright, and DMCA Policy

1. Scope

This Policy applies to all videos and other content ("User Content") uploaded to or submitted through PerfectSwingAI.

By uploading User Content, you agree to comply with this Policy and our Terms of Service.

2. Your Rights to the Footage

You may only upload videos if:

  • You created the footage yourself; or
  • You have obtained all necessary rights, permissions, and licenses from the copyright owner(s) to record, upload, and use the footage for biomechanical analysis.

You must NOT upload:

  • TV or online broadcasts of professional matches.
  • Tournament streams or broadcasts (e.g., ATP/WTA, ITF, college, or other events) unless you have explicit permission.
  • Content downloaded from YouTube, streaming platforms, or social media unless you have the legal right to use and upload it for analysis.

You are solely responsible for ensuring that your uploads comply with applicable copyright laws.

3. Use of Footage by PerfectSwingAI

We use your uploaded videos solely to:

  • Run pose-estimation and biomechanical analysis.
  • Generate visualizations and reports for you.

Videos are stored only temporarily for processing and are automatically deleted upon completion of analysis or within 24 hours, whichever comes first.

We do not:

  • Sell, license, or publicly distribute your videos.
  • Use your videos for marketing without your explicit additional consent.

We may retain derived biomechanical data (such as joint positions, angles, and timing metrics) in de-identified or aggregated form for service improvement and benchmarking, as described in our Privacy Policy.

4. DMCA Copyright Infringement Notices

If you believe that content hosted on the Service infringes your copyright, you may submit a notice under the Digital Millennium Copyright Act (DMCA) to our designated copyright agent.

Your notice must include:

  1. A physical or electronic signature of the person authorized to act on behalf of the copyright owner.
  2. Identification of the copyrighted work claimed to have been infringed, or a representative list if multiple works are covered.
  3. Identification of the material that is claimed to be infringing, and information reasonably sufficient to permit us to locate the material.
  4. Your contact information, including address, telephone number, and email address.
  5. A statement that you have a good-faith belief that use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law.
  6. A statement that the information in the notification is accurate and, under penalty of perjury, that you are authorized to act on behalf of the copyright owner.

5. Removal of Content and Repeat Infringers

Upon receiving a valid DMCA notice, we may:

  • Remove or disable access to the allegedly infringing content.
  • Notify the user who uploaded the content.
  • Take appropriate action, which may include terminating accounts of repeat infringers in appropriate circumstances.

If you believe that content was removed in error or as a result of misidentification, you may submit a counter-notification as allowed under the DMCA.
