PerfectSwingAI ("PerfectSwingAI", "we", "us", or "our") is operated by South Bay Intelligence Inc., based in California, USA.

This Privacy Policy explains how we collect, use, store, and protect information when you use our video-based biomechanical analysis service (the "Service").

We are committed to handling your information responsibly and in compliance with applicable privacy laws, including the General Data Protection Regulation (GDPR), the California Consumer Privacy Act (CCPA), and similar laws where they apply.

By using the Service, you agree to the practices described in this Policy.

2. Information We Collect

2.1 User-Uploaded Videos

  • You may upload athlete videos to request an analysis.
  • Videos are used solely to run pose-estimation and biomechanical analysis, and to generate visualizations and reports for you.
  • We do not store your videos permanently.
  • Videos are processed in short-lived storage and are deleted automatically upon completion of processing or within 24 hours, whichever comes first.

2.2 Derived Biomechanical Data

From uploaded videos, we may generate and retain "derived biomechanical data," such as:

  • Joint positions and angles.
  • Timing, speed, and sequence metrics.
  • Movement comparison and scoring metrics.

We do not retain raw video or audio as part of this data. Derived data is structured to minimize direct identification and, where possible, is stored in aggregated or pseudonymized form.

2.3 Account and Contact Information

If you create an account or contact us, we may collect:

  • Name.
  • Email address.
  • Password (hashed).
  • Sport, position, or skill level (optional).
  • Club/academy details (for coach or team accounts).
  • Support requests and communications.

2.4 Payment Information

If you purchase credits or subscriptions:

  • Payments are processed by third-party processors (e.g., Stripe or similar).
  • We do not store full payment card numbers on our servers.
  • We may receive limited billing information (e.g., last 4 digits, card type, transaction ID) from the processor for record-keeping.

2.5 Device and Usage Data

We may automatically collect:

  • IP address (stored for a limited period for security and fraud prevention).
  • Browser type and version.
  • Operating system.
  • Referring URL and pages visited.
  • Timestamps and usage patterns (e.g., number of analyses requested).

We may use tools such as Google Analytics or equivalent (configured, where possible, to minimize identifiability).

2.6 Children and Minors

Our Service is intended for adults (18+) and for minors whose parent/legal guardian has agreed to these Terms and this Policy.

  • We do not knowingly allow children under 13 to create accounts.
  • If we learn that a child under 13 has provided personal information without verifiable parental consent, we will delete such information.

3. How We Use Your Information

We use the information we collect to:

  • Provide, operate, and maintain the Service (including processing videos and generating analysis reports).
  • Communicate with you about your account, purchases, and support requests.
  • Improve, test, and enhance our models and algorithms (using anonymized or pseudonymized data where feasible).
  • Detect, prevent, and address technical issues, abuse, or security incidents.
  • Comply with legal obligations and enforce our Terms of Service.

We do not sell, rent, or trade your personal data to third parties.

4. Legal Bases for Processing (GDPR)

If you are located in the EU/EEA or the UK, our legal bases for processing your information include:

  • Consent – You choose to upload videos and request analysis.
  • Contractual necessity – We process data to provide the Service you have requested.
  • Legitimate interests – We retain derived biomechanical data in anonymized or pseudonymized form to improve accuracy, train models, and benchmark performance, in a way that does not unduly impact your privacy.
  • Legal obligations – We may process data to comply with tax, accounting, or regulatory obligations.

5. Data Storage and Retention

  • Videos: Stored only for processing and automatically deleted upon completion or within 24 hours at the latest.
  • Derived biomechanical data: Retained as long as necessary to provide your reports and account history, and to improve, benchmark, and ensure the quality of our models.
  • Account data: Retained while your account is active and for a reasonable period thereafter (e.g., for legal, accounting, or security purposes).
  • Support communications: Retained for the time needed to address your request and to maintain records of interactions.

You may request deletion of your account and associated personal information as described in Section 7.

6. Sharing of Information

We may share information with:

  • Service providers / processors who assist with cloud hosting and storage, video processing infrastructure, payment processing, and analytics and error monitoring.
  • Professional advisers (lawyers, accountants, insurers) as needed.
  • Authorities where required by law, court order, or to protect legal rights.

We require third-party service providers to use data only for our instructions and to protect it appropriately.

We do not permit third parties to use your uploaded videos for their own independent purposes.

You may have the right to:

  • Request deletion of your personal data (subject to legal retention requirements).
